Is It Illegal to Drink and Drive in Phuket, Thailand?

Yes: driving after drinking in Thailand is a criminal offence that can end in arrest, and the legal limit is 50 mg% of alcohol in the blood, or 20 mg% for drivers under 20, on a temporary licence, without a valid licence or with a licence for another vehicle type. With a rental car there is a second, simpler rule: the insurance does not apply at all to a driver who has been drinking, so the only amount that keeps you covered is none. Plan the evening so the car stays parked and you go back by taxi or app, and the question never comes up.

What happens if you drink and drive in Phuket?

Three things, and none of them is small.

First, the law. Thailand treats drink driving as a criminal matter, and a driver stopped over the limit can be arrested on the spot. Second, the police. Night checkpoints are a normal part of Phuket roads, set up on the main routes out of the nightlife areas, and they are not avoided by clever routing. Third, and the one visitors forget, the rental.

First, the law. Under Thailand's ministerial regulation on alcohol testing of B.E. 2567 (2024), a driver is legally drunk above 50 mg% of alcohol in the blood, and above 20 mg% if under 20, on a temporary licence, driving without a valid licence or on a licence for a different type of vehicle. It is a criminal matter, and a driver over the limit can be arrested on the spot. Second, the police. Night checkpoints are a normal part of Phuket roads, and they are not something you avoid with clever routing. Third, and the one visitors forget, the rental.

Because first-class commercial insurance on a rental car covers a sober driver named on the agreement, and nobody else. After a collision with alcohol involved, the claim is declined in full. The damage to your car, the damage to the other car and anything beyond it are then settled out of your own pocket, on a holiday budget, in a foreign country.

That is why our advice is not a number but a habit. On an evening with drinks, the car stays where it is and you take a taxi or a ride app back. In the morning you collect it, rested, and nothing has happened.

What that means for the car

Plan where the car sleeps before the evening starts. If dinner is near your hotel, walk. If it is across the island, leave the car at the hotel and go by app, or park it somewhere you are happy to leave it overnight.

The roads make the rule even more sensible. The hill roads in Phuket are unlit for their whole length, scooters often ride without a rear light, and the passes into Patong and Kata have tight bends and long descents. Those are demanding roads for a completely sober driver at night.

Only drivers named on the agreement may take the wheel, too. Handing the keys to a friend who "only had one" does not solve anything: an unlisted driver voids the insurance just as alcohol does.

  • Dinner nearby — walk, the car stays at the hotel
  • Evening across the island — go by taxi or app
  • Drinks at a sunset bar — the car stays, collect it tomorrow
  • Friend offers to drive — only if named on the agreement and sober

Songkran and festival nights

Festival days bring the highest accident rate on Thailand's roads, and the main cause is drivers who have been drinking. During Songkran and on big celebration nights, plan any trips for daylight and keep a larger gap than usual.

It is not only about your own glass. On those nights the other drivers are the risk, so the calmest plan is to stay off the road after dark altogether. More in Songkran driving guide.

ImportantIf you have been drinking, do not drive the rental car at all, not even a short way to the hotel. Insurance does not apply to a driver who has been drinking, and a checkpoint or a small bump turns a good evening into a criminal case and a bill for everything.

How do people get home after a night out?

By app or taxi, almost always. Ride apps work across the busy parts of the island, and taxis wait outside the main nightlife streets. It costs a little on the night and saves the whole holiday.

A little planning makes it painless. Save your hotel's name and address in the phone before you go out, so any driver can find it, and agree with the table which way home before the last round rather than after it. If you are staying somewhere quiet, a hotel reception can often call a car for the return when you ask in advance.

In the morning, the car is where you left it. If that is in Patong, go early, before the beach parking fills, and drive back rested. The comparison of the two ways to get around is in rent a car or use Grab in Phuket.

Can we plan the rental around this?

Yes, and many couples do. One driver named on the agreement for the days out, taxis for the evenings, and nobody has to decide at midnight who is fine to drive.

Send the dates, your hotel and the drivers' names in the chat: we deliver an automatic with first-class commercial insurance to your hotel or the airport at any hour, with a refundable deposit and the total for your dates fixed before you arrive.

Common questions

Is it illegal to drink and drive in Thailand?

Yes. It is a criminal offence, and a driver stopped after drinking can be arrested. Police checkpoints at night are common in Phuket.

Does rental car insurance cover me if I have been drinking?

No. Insurance does not apply at all to a driver who has been drinking, so after an accident you pay for all the damage yourself.

How much can I drink before driving in Phuket?

The legal limit is 50 mg% in the blood, or 20 mg% for young and temporary-licence drivers. With a rental car, though, the insurance stops covering a driver who has been drinking at all, so the only safe amount is none.

Are there police checkpoints in Phuket at night?

Yes, they are routine after dark. Drivers are stopped and asked for documents, and a driver who has been drinking is dealt with on the spot.

How do I get back to my hotel after a night out?

By taxi or a ride app. Leave the rental car where it is and collect it in the morning, rested.

Can my friend drive the car if I have been drinking?

Only if they are named on the agreement and have not been drinking. An unlisted driver voids the insurance just as alcohol does.
